Terms of Service

1. Acceptance of terms

By accessing or using Spark2Build (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms govern your use of the platform operated by Spark2Build ABN 23 462 031 893 (“we”, “us”, “our”).

2. Use of the service

You may use Spark2Build only for lawful business purposes. You agree not to:

• Upload content that infringes intellectual property rights
• Attempt to gain unauthorised access to any part of the platform
• Use the Service to store or process personal data in violation of applicable privacy laws
• Reverse engineer, decompile, or disassemble the Service
• Resell or sublicense access to the Service without our written consent

3. Your content

You retain ownership of all knowledge entries, sparks, and other content you upload to Spark2Build. By uploading content, you grant us a limited, non-exclusive licence to process that content for the purpose of providing the Service, including sending it to OpenAI for AI analysis.

4. AI-generated output

Spark2Build uses AI to generate analysis, relationship suggestions, and gap detection output. This output is provided for informational purposes only. We make no warranty that AI output is accurate, complete, or fit for any particular purpose. You are responsible for reviewing and validating all AI-generated content before acting on it.

5. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may perform maintenance, introduce updates, or temporarily suspend the Service with reasonable notice where possible. We are not liable for losses resulting from unavailability.

6. Limitation of liability

To the extent permitted by Australian law, our total liability to you for any claim arising from your use of the Service is limited to the fees you paid in the three months prior to the claim. We are not liable for indirect, incidental, or consequential losses.

7. Termination

Either party may terminate the agreement with 30 days written notice. We may terminate immediately if you breach these terms. Upon termination, your access to the Service will cease and we will delete your data within 30 days, unless retention is required by law.

8. Governing law

These terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
